What is an Examination Under Oath?

An examination under oath, or EUO, is a sworn testimony given by the insured in front of the insurance company's attorney and a court reporter, who records the testimony verbatim. An EUO is set up by an insurance company to get information that may be used to deny a claim.

During an examination under oath, any number of questions may be asked. The insurance companies want to find out every detail about you, your life, your claim and your background. They may ask questions about your family, employment history, assets, credit history or the details of your claim. Being unprepared for an EUO -even answering one question wrong - can result in the failure of your claim.

How We Can Help

Examinations under oath are typically done on claims that are being investigated. If you have been asked to take an EUO, an insurance company may suspect you of committing insurance fraud or may be seeking do deny the claim. We can represent you on an hourly basis.

If you are facing an EUO in Colorado, our attorneys offer representation that can benefit you in many ways:

  • Explaining how an EUO works
  • Preparing you for an EUO testimony
  • Preparing you for the techniques the insurance company's lawyer will use against you during the EUO
  • Representing you during the EUO, ensuring that the other attorney asks appropriate, fair questions

If you go into an EUO unprepared, even one piece of information can be used against you to deny your claim. Whether you have an insurance claim dispute or a coverage dispute, it is important to go to your EUO fully prepared.
